1. Agreement
These Terms of Service (“Terms”) are a contract between you and Tuyo Labs (“Tuyo”, “we”, “us”) and govern your use of the Tuyo apps, widgets and website (the “Services”). By creating an account or using the Services you agree to these Terms and to our Privacy Policy.
In plain words: be kind, only send things you have the right to send, and don't use Tuyo to hurt anyone.
2. Eligibility & accounts
- You must be at least 13 years old (14 in Spain), or older if required in your country.
- You're responsible for your account and for keeping your sign-in credentials secure.
- Provide accurate information and keep it up to date.
- One person per account; accounts are not transferable.
3. Your content
You own the doodles, photos and notes you create (“Your Content”). You grant Tuyo a worldwide, non-exclusive, royalty-free licence to host, store, transmit and display Your Content solely to operate and provide the Services to you and the person you are connected with. This licence ends when you delete Your Content or your account, except for copies already delivered to your partner's device.
We do not use Your Content to train machine-learning models.
4. Acceptable use
You agree not to use the Services to:
- Harass, threaten, stalk or intimidate anyone, or send content to someone who doesn't want it;
- Share sexual content involving minors, non-consensual intimate imagery, or content that promotes violence;
- Infringe anyone's intellectual property or privacy rights;
- Send spam, malware or attempt to access accounts or systems without permission;
- Reverse engineer, scrape or interfere with the Services, except as permitted by law.
We may remove content or suspend accounts that violate these Terms. You can report abuse from the app or at support@tuyo.space.
5. Tuyo+ subscriptions
- Tuyo+ can be bought in the app through the Apple App Store or Google Play (billing governed by their terms), or on our website. Website purchases are processed by Dodo Payments, which acts as the merchant of record and handles payment, invoicing and sales tax/VAT. All prices are in US dollars (USD); applicable taxes are shown at checkout.
- Web subscriptions can be cancelled at any time from the link in your Dodo Payments receipt or by emailing support; cancellation takes effect at the end of the current billing period.
- Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before renewal in your store account settings.
- Free trials convert to a paid subscription unless cancelled before the trial ends. Any unused trial time is forfeited when you purchase.
- One subscription unlocks Tuyo+ for both connected partners while they remain connected.
- Refunds for in-app purchases are handled by Apple or Google; refunds for web purchases are handled by us together with Dodo Payments — contact support. EU/UK consumers may have a 14-day right of withdrawal; by starting to use Tuyo+ immediately you acknowledge that this right may be lost once the digital service has been fully provided.
6. Our intellectual property
The Services, including the Tuyo name, logo, heart mark, stickers, brushes and software, are owned by Tuyo and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the apps for your own non-commercial purposes.
7. Termination
You can stop using Tuyo and delete your account at any time. We may suspend or terminate access if you breach these Terms or if required by law, and will try to give notice where reasonable. Sections that by their nature should survive termination will survive.
8. Disclaimers
The Services are provided “as is” and “as available”. Delivery of doodles depends on third-party networks and operating-system features (such as push notifications, widgets and Live Activities) that we don't control, so we can't guarantee that every doodle will arrive instantly or at all. To the fullest extent permitted by law, we disclaim all implied warranties. Nothing in these Terms limits rights you have as a consumer that cannot be excluded by law.
9. Limitation of liability
To the extent permitted by law, Tuyo will not be liable for indirect, incidental, special or consequential damages, and our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or USD $50. These limits do not apply to liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.
10. Governing law & disputes
If you live in the EU/EEA: these Terms are governed by the laws of Spain and you may bring claims in the courts of your country of residence. The EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
If you live in the US: these Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally within 60 days.
11. Changes
We may update these Terms. If a change is material we'll notify you in the app or by email at least 30 days before it takes effect. Continuing to use the Services after that means you accept the updated Terms.
